  1. Are any states still increasing? It looks like in CDC data, Virginia numbers are exploding.

  2. Lucia,
I am not AT ALL surprised.

I do not know how these lawsuits will play out, especially when they reach the Federal level…. which is almost inevitable. But the multitude of State restraining orders are plainly unconstitutional on their face, in multiple violations of the first amendment. There will inevitably be dueling court orders, and ultimately the SC will have to “take the matter under consideration”. I am not optimistic about the SC, since they seem to me far too enamored of past rulings to actually block the many unconstitutional rules in a timely way.

That said, there is always a chance, however small, they will suck up enough courage to actually protect constitutional freedoms. More likely they will, in a very Roberts-like charade, dance around the constitutional issues until the orders lapse and then declare all the first amendment based suites moot, and refuse to rule. IMO, Roberts was George W. Bush’s worst judicial nomination, and that includes the ones who were shouted down before going to the Senate.

  3. Kenneth,
Yes, of course. But thinking of opportunity costs and future lost lives (and future lost livelihoods) requires a) some actual thinking, and b) getting past the selfish and infantile “I want safety now!” mindset, which unfortunately, dominates the public discourse and the mindless politicians promulgating mindless public policy.

  4. My simple averaging now has Illinois at 104 deaths per day with a gain of 1 death per day. It’s almost flat, but after being in lockdown for this long it’s a bit concerning that Ro still appears to be above 1.

  5. The question is how many are dying of coronavirus and how many are dying of fear of the virus. A lot of the latter will be delayed.
